The following terms (“Terms of Use”) are a legal agreement between you and Würth Elektronik GmbH & Co. KG, including their Affiliates (hereinafter “Würth Elektronik”). “Affiliates” are companies in which Würth Elektronik directly or indirectly holds more than half of the votes or has the power to appoint more than half of the members of the supervisory board, board of management or bodies legally representing the company or has the right to manage the company’s affairs.

consisting of the following services:
a) MyWE: an online platform providing business relevant information, b) REDEXPERT: an online platform for easy component selection, simulation and design, c) Online Catalog: an online platform providing an overview of components, d) Website: the Würth Elektronik website, e) User Profile: a user profile containing customers’ personal information and access credentials for Würth Elektronik services, f) WEdirekt: an online shop for ordering PCBs and stencils fast and easy, g) Powerelement.com: an online platform for high-current contacts (power elements) and additional printed circuit board components (hereinafter individually or collectively “WE Online Services“)
Your use of the WE Online Services rests on the condition that you accept the terms and conditions of these Terms of Use. By using the Online Services, you accept these Terms of Use. Additional terms of use may apply to individual WE Online Services. Your use of the individual WE Online Services rests on the condition that you accept the additional terms of use for the individual WE Online Services.
You are authorized to use the WE Online Services in accordance with these Terms of Use.
You understand and agree that you remain solely responsible for using your own independent analysis, evaluation and judgment in designing your systems and products. You acknowledge and agree that you are solely responsible for compliance with all legal, regulatory and safety-related requirements relating to your own products and to the use of Würth Elektronik products and solutions (hereinafter “WE Products”) in your applications, regardless of any application-related information or support provided by Würth Elektronik and/or through the WE Online Services.
Responsibility for the applicability and use of WE Products in a particular design always lies solely with the user.
Accordingly, it is your responsibility to assess, investigate where appropriate, and decide whether the WE Products, with the specific characteristics described in the specifications, are valid and suitable for your respective application.
If you determine that the WE Products are valid and suitable for a particular design and wish to order the relevant WE Products, you acknowledge that you must minimize the risk of loss and harm to individuals and that you bear the risk of failure resulting from your use of the WE Products where such failure may lead to personal injury or death.
The WE Products have been designed and developed for use in general electronic equipment only. WE Products are not authorized for use in equipment for which a particularly high safety and reliability standard is required or where a failure of the WE Products can reasonably be expected to cause severe personal injury or death, unless the parties have entered into an agreement specifically governing such use.
Furthermore, the components of Würth Elektronik eiSos GmbH & Co. KG are neither designed nor intended for use in fields such as military, aerospace, nuclear control, submarine applications, transportation (vehicle control, train control, ship control), traffic signaling, disaster prevention, medical applications, public information networks, etc. Würth Elektronik eiSos GmbH & Co. KG must be informed of any intended such use before the design-in stage. In addition, sufficient reliability evaluations for safety must be performed for every component used in electrical circuits requiring high safety and reliability functions or performance.
For printed circuit boards sold by Würth Elektronik GmbH & Co. KG, you must obtain Würth Elektronik GmbH & Co. KG’s prior written approval before incorporating such printed circuit boards into equipment in fields such as, including but not limited to, military, aerospace, aviation, nuclear control, submarine applications, transportation (vehicle control, train control, ship control), traffic signals, disaster prevention, medical applications, or any other
purpose for which particularly high safety and reliability are required or where severe damage or personal injury may occur.
For power elements and additional printed circuit board components sold by Würth Elektronik ICS GmbH & Co. KG, you must obtain Würth Elektronik ICS GmbH & Co. KG‘s prior written approval before incorporating them into equipment in fields including, but not limited to, military, aerospace, nuclear control, submarine applications, transportation (vehicle control, train control, ship control), transportation signals, disaster prevention, medical
applications, or any other purpose for which particularly high safety and reliability are required or where serious damage or injury to life, body or health may occur.
YOU SHALL INDEMNIFY WÜRTH ELEKTRONIK AGAINST ALL DAMAGES ARISING OUT OF THE USE OF WE PRODUCTS IN SUCH SAFETY-CRITICAL APPLICATIONS.
Würth Elektronik assumes no responsibility for updating the WE Online Services to keep information current or to ensure the accuracy and completeness of the WE Online Services. Accordingly, you should verify the accuracy and completeness of all published information before making any decision relating to any services, products or other matters described in the WE Online Services. Würth Elektronik gives no assurance that any reported technical issue will be resolved by Würth Elektronik, even if Würth Elektronik elects to provide information intended to address the issue. Würth Elektronik makes no representation that the WE Online Services are appropriate or available for use in other regions of the world.
Only authorization to use the WE Online Services is granted. NO OTHER LICENSE, EXPRESS OR IMPLIED, BY ESTOPPEL OR OTHERWISE, TO ANY OTHER WÜRTH ELEKTRONIK INTELLECTUAL PROPERTY RIGHT, AND NO LICENSE TO ANY THIRD-PARTY TECHNOLOGY OR INTELLECTUAL PROPERTY RIGHT, IS GRANTED HEREUNDER, INCLUDING, BUT NOT LIMITED TO, ANY PATENT RIGHT, COPYRIGHT, MASK WORK RIGHT OR OTHER INTELLECTUAL PROPERTY RIGHT RELATING TO ANY COMBINATION, MACHINE OR PROCESS IN WHICH WÜRTH ELEKTRONIK COMPONENTS, PRINTED CIRCUIT BOARDS OR SERVICES ARE USED.
Information published by Würth Elektronik regarding third-party products or services does not constitute a license to use such products or services, nor a warranty or endorsement thereof. Use of such information may require a license from a third party under that third party’s patents or other intellectual property, or a license from Würth Elektronik under Würth Elektronik’s patents or other intellectual property rights.
You agree not to use the WE Online Services in any manner that violates applicable law or regulation, or that interferes with or disrupts the WE Online Services or any servers or networks connected to the WE Online Services. You agree not to use any data mining or similar data gathering or extraction methods in connection with the WE Online Services, or framing techniques to enclose trademarks, logos, proprietary or other information (including, without limitation, datasheets, images, text, page layout or form), and not to attempt to gain unauthorized access to any portion of the WE Online Services or any other accounts, computer systems or networks connected to the WE Online Services, whether through hacking, password mining or any other means.
Reproduction of information or data made available by the WE Online Services or Würth Elektronik is permitted, provided that such reproduction is unaltered and includes all required terms and notices. Würth Elektronik is not responsible or liable for any altered reproduction. Third-party information may be subject to additional restrictions. Unauthorized use of the WE Online Services may result in legal action. Würth Elektronik may suspend your access to all or any part of the WE Online Services at any time without prior notice.
In order to obtain full access to the WE Online Services, registration is required. Registration takes place in two steps:
1) Ping Identity
Ping Identity is an identity and authentication application. The information required for this registration step is marked with an asterisk as mandatory. This information includes your title, first name, surname and e-mail address. To prevent unauthorized third-party access to your Ping Identity account, you must set a personal password during registration. After submitting the registration form in Ping Identity, we will send you an e-mail containing a registration code that you must use to confirm your registration. By entering the registration code in the input field provided, you can activate access to your Ping Identity account. If you do not activate access within 48 hours, your information will be automatically deleted.
2) WEID
To ensure that no unauthorized third parties gain access to your data, you will be asked in a second step to provide additional key data about your company. This information is marked with an asterisk as mandatory. The required information includes the company name, the country in which the company is based, the company address, and the Würth Elektronik business units relevant to you. This information is used to link your customer account to the correct ERP customer accounts or to create new customer accounts in the ERP systems.
In the course of your registration, the responsible Würth Elektronik internal sales staff will receive a corresponding notification of your registration including the relevant details. In the case of an existing business relationship, this data is used to assign you to existing ERP customer accounts. If no business relationship exists, this information is used to create a new ERP customer account.
Once you have completed the registration process described above, you will have full access to the WE Online Services.
You represent and warrant that all information provided to Würth Elektronik in connection with your account registration is current, complete and correct, and that you will update such information following any change that renders it incomplete or incorrect. If you leave the company stored in your WE ID, you are solely responsible for ensuring that your account is deleted before leaving the company. For this purpose, you must send an e-mail requesting deletion to WEID-support@we-online.com. Würth Elektronik will then delete your account.
You are responsible for maintaining the confidentiality of your account, and you agree to accept responsibility for all activities that occur under your account. Würth Elektronik reserves the right, in its sole discretion, to terminate your account at any time and without prior notice if Würth Elektronik suspects that any information provided by you is untrue, inaccurate, incomplete, outdated, misleading or fraudulent.
By means of certain features of the WE Online Services, you may post or share information. You may post or share reviews, comments and other content or information, provided that such content is not copyrighted, confidential, illegal, obscene, threatening, defamatory, invasive of privacy, infringing intellectual property rights, otherwise harmful to third parties, or otherwise objectionable, as determined by Würth Elektronik in its sole discretion, and does not consist of or contain software viruses, political campaigning, commercial solicitation or any form of spam. You may not use a false e-mail address, impersonate any natural or legal person, or otherwise mislead as to the origin of any information or other content.
If you post or share any information, you grant Würth Elektronik a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post, that you have acquired all necessary rights in such content to enable you to grant to Würth Elektronik the rights in such content described herein, that the content is accurate, that use of the content you supply does not violate this policy and will not cause injury to any person or entity, and that you will indemnify Würth Elektronik for all claims resulting from content you provide.
Würth Elektronik has the right but not the obligation to monitor and edit or remove any activity or content. Würth Elektronik takes no responsibility and assumes no liability for any content posted by you or any third party.
In certain instances it is for the user to upload or otherwise provide information on the WE Online Services which is directly related to initiate an order process. To clarify, this information shall not be posted or shared by Würth Elektronik except for the purpose of and limited to the transaction.
Within the WE Online Services, Würth Elektronik may provide certain links and third party embedded content which allows you to leave WE Online Services, enter non-Würth Elektronik websites, and/or view and access content on third party websites (collectively, “Third Party Content”). Würth Elektronik does not control Third Party Content and is not responsible for such content, or any changes or updates to such content. Use of Third Party Content is governed by the applicable terms of use and privacy practices of such website and services. WE ONLINE SERVICES ARE PROVIDED “AS IS.” WÜRTH ELEKTRONIK MAKES NO WARRANTIES OR
REPRESENTATIONS WITH REGARD TO WE ONLINE SERVICES OR USE OF WE ONLINE SERVICES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING FOR ACCURACY, COMPLETENESS, OR SECURITY. WÜRTH ELEKTRONIK DISCLAIMS ANY WARRANTY OF TITLE AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR QUIET ENJOYMENT OF WE ONLINE SERVICES. WÜRTH ELEKTRONIK SHALL NOT BE LIABLE FOR AND SHALL NOT DEFEND OR INDEMNIFY YOU AGAINST ANY THIRD PARTY INFRINGEMENT CLAIM THAT RELATES TO OR IS BASED ON A COMBINATION OF COMPONENTS, PCB’S, SOLUTIONS OR SERVICES PROVIDED IN WE ONLINE SERVICES AND ARE NOT ATTRIBUTABLE TO WÜRTH ELEKTRONIK. IN NO EVENT SHALL WÜRTH ELEKTRONIK BE LIABLE FOR ANY INCIDENTAL, UNFORESEEABLE, OR UNTYPICAL DAMAGES AS WELL AS LOSS OF PROFIT.
The preceding provisions do not imply a change in the burden of proof to your detriment.
Würth Elektronik provides its policy regarding Data Protection on its website. Please review the Data Protection, to understand the practices. The use of WE Services is also governed by the Data Protection.
Applicable law to these Terms of Use shall be the laws of the Federal Republic of Germany.
In the event of any dispute or claim arising out of or relating to this Agreement including without limitation any question regarding its enforcement, interpretation, validity or breach, the Parties shall first attempt to resolve such dispute in a confidential and amicable way.
In the event no settlement is reached within a period of sixty (60) calendar days from the date of request for such negotiations, the case shall be finally settled by arbitration referred to the German Institution of Arbitration (Deutsche Institution für Schiedsgerichtsbarkeit e.V, DIS) in accordance with its arbitration rules. The procedural law of Germany shall apply where arbitration rules are silent. The place of arbitration shall be in Frankfurt. The language of arbitration shall be English. Each Party shall appoint an arbitrator and the appointed arbitrators shall then jointly designate a third arbitrator. The arbitral award is final and binding upon both Parties. The arbitration shall be confidential. The Parties agree that also the mere existence of an arbitration proceeding shall be kept confidential, except to the extent disclosure is required by law, regulation or an order of a competent court.
If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. The parties shall replace any such provisions with new valid provisions that most closely approximate the purpose of the terms. The above-mentioned provisions are also valid in the event that these Terms of Use are determined to contain gaps.
Würth Elektronik may stop or change the operation of its WE Online Services in full or in part at any time. Würth Elektronik reserves the right at any time to change these terms at its own discretion. It is your responsibility to check these terms for any updates before your use. Your continued use of WE Online Services will be deemed as the acceptance of the change.
The following Terms of Use for the individual WE Online Services shall apply in addition to the Terms of Use:
MyWE
On MyWE, Würth Elektronik provides a Tracking Widget, Order Process and History Widget, a component history, an overview of your favorite components and a research panel (collectively “MyWE Services”).
a) Shipment Tracking
Würth Elektronik provides you with a shipment tracking widget on MyWE. The tracking widget provides you with an overview of current or past deliveries. The view on the dashboard gives you a quick overview of current deliveries. With the help of the history function, you shall be able to view past deliveries. In the respective detailed views of the deliveries, you shall be able to receive further information. In addition, the history function is equipped with a search function.
The information provided to you in this tool is the information Würth Elektronik receives from the carrier. Würth Elektronik is not responsible for the accuracy and/or completeness of this information.
You shall be able to download the delivery and invoice documents in PDF format. In regards to these files you shall be allowed to download and save these files to your device. You shall be allowed to use them for your intended business purpose. You must not share these files with third Parties.
b) Order Process & History
Würth Elektronik provides you with an order process and history widget (“OPH”) on MyWE. The OPH widget serves as a process overview of your current interactions with Würth Elektronik. With this widget, you can initiate new inquiries and orders. A name must be assigned to the process, and the inquiry/order must be completed either on the basis of a product selection or by uploading a file. In addition, you may enter a desired delivery date, adjust the delivery and billing address, and add notes. You may save inquiries as drafts and complete them at a later time. Received offers may be converted into an order request, and order requests may also be initiated on the basis of documents.
In addition to initiating order processes, this widget also allows you to open detailed views of existing processes and obtain more detailed information on individual processes.
In addition to the process name, contacts, delivery and billing address, the content of the process (files or product tables) will be displayed to you. It is also possible to download official documents in PDF format. With regard to downloadable documents, you may download and store these files on your device and use them for your intended business purposes. You must not share these files with third parties. Within the OPH widget, you may upload files.
With regard to such files, you may only upload files containing information relevant to your inquiries, offers or orders and that are not illegal, obscene, threatening, defamatory, invasive of privacy, infringing intellectual property rights, otherwise harmful or objectionable to third parties, as determined by Würth Elektronik in its sole discretion, and that do not consist of or contain software viruses, political campaigning, commercial advertising or any form of spam.
Please note that each file you upload in this widget will be regarded as a new offer from you that leads to an inquiry and not as an acceptance resulting in a legally binding order. Every file uploaded by you must be reviewed and expressly accepted by Würth Elektronik in order to result in a legally binding order. If you accept Würth Elektronik’s offer by clicking the button labeled “Order now”, you place a legally binding order. After placing your order, you will receive a confirmation from Würth Elektronik. Within this widget, you may share the items from your order list for your intended business purposes. You may only share such items as provided and must not alter any of the information made available.
c) Components/Products History and Favorite Components/Products
The components/products history gives you an overview of components/products that you have already purchased. In addition to listing the components/products history, you may also add further components/products to the components/products list and mark them as favorites.
Within this widget, there are additional options for interacting with the components/products shown, including, but not limited to, jumping directly to the respective catalog page or downloading existing component/product files for the relevant component/product directly from MyWE. With regard to downloadable documents, you may download and store these files on your device and use them for your intended business purposes. You must not share these files with third parties. In addition, you may share the components/products via link or use them in another inquiry or for ordering via the shopping cart. In this widget, Würth Elektronik provides pictures of various components/products. You are not permitted to use such pictures in any form whatsoever.
d) Knowledge Widget
Würth Elektronik provides you with a Knowledge Widget, with which you can explore the Würth Elektronik online world and discover more online services, information and websites from Würth Elektronik. It allows you to add services to your favorites and share the link to the websites
